Distance Selling Agreement

Distance selling agreement for digital service purchases.

This agreement governs the mutual rights and obligations of the parties regarding online service sales in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

ARTICLE 1 – PARTIES

1.2. BUYER (Customer)

The identity and contact information declared by the BUYER during the order or registration phase shall be taken as the basis. The BUYER is responsible for the accuracy of this information.

ARTICLE 2 – SUBJECT OF THE AGREEMENT

The subject of this agreement is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and performance of IT services (Domain, Hosting, Cloud Server, SSL, etc.) ordered electronically by the BUYER via the SELLER's website.

ARTICLE 3 – PERFORMANCE AND DELIVERY OF THE SERVICE

The contracted service is delivered electronically (online) after the BUYER successfully completes the payment. There is no physical shipment. Activation details regarding digital services are sent to the BUYER's registered email address.

ARTICLE 4 – RIGHT OF WITHDRAWAL

In accordance with Article 15(1)(ğ) of the Regulation on Distance Contracts titled "Exceptions to the Right of Withdrawal", there is no right of withdrawal for "contracts regarding services performed instantly in electronic environment or intangible goods delivered instantly to the consumer".

The BUYER accepts, declares, and undertakes that they CANNOT EXERCISE THE RIGHT OF WITHDRAWAL for services performed instantly in the electronic environment, such as domain name registration, SSL certificates, software licenses, and servers.

ARTICLE 5 – DECLARATIONS AND COMMITMENTS OF THE BUYER

The BUYER declares that they have read and are informed about the preliminary information regarding the basic characteristics, sales price, payment method, and performance of the contracted service on the website, and have given the necessary confirmation in the electronic environment.
The BUYER agrees to comply with the laws of the Republic of Turkey, general moral rules, and IT law standards during the use of the service.
Hosting copyright-infringing content or engaging in illegal broadcasts (phishing, spam, hacking activities) is prohibited. In such cases, the SELLER has the right to unilaterally terminate the agreement.

ARTICLE 6 – DISPUTE RESOLUTION

In the implementation of this agreement, Consumer Arbitration Committees and Consumer Courts in the place where the BUYER purchased the goods or services and where their residence is located are authorized up to the value declared by the Ministry of Customs and Trade.
